Terms and conditions.
The terms that apply to every quote, equipment hire, production, sale, installation and service from Coastal Sound and Lighting.
Last updated: 27 October 2026
These terms are set out in six parts. Part A applies to everything we do. The other parts add terms for particular kinds of work and apply alongside Part A. If a clause in Parts B to F conflicts with Part A, the more specific clause applies to that work.
Part A: General terms
1. About these terms
1.1 These terms apply whenever you get a quote from, book, hire from, buy from or engage Coastal Sound and Lighting Pty Ltd (ABN 13 696 546 488) of 47/8 Distribution Court, Arundel QLD 4214 ("we", "us", "our" or "CSL").
1.2 "You" means the person, business or organisation named on our quote, contract or invoice. If more than one is named, each of you is responsible for the whole amount and all obligations, both separately and together. If you book on behalf of someone else, you confirm you have their authority, and you are personally responsible if you don't.
1.3 In these terms:
- Equipment means anything we supply on hire, including cases, cables, rigging, consumables and accessories.
- Goods means anything we sell to you.
- Services means production, crew, design, programming, event management, installation, repair and any other work we do.
- Booking means an accepted quote or contract for Equipment, Goods or Services.
- Bump-in means the first day we deliver, collect out or begin setting up for a Booking.
- Price means the amount on our quote, contract or invoice, as adjusted under these terms.
1.4 You accept these terms when you sign or digitally accept a quote or contract, pay a deposit or invoice, issue a purchase order, or take delivery of Equipment, Goods or Services. Terms on your purchase order or other documents don't apply unless we agree to them in writing.
1.5 If a signed quote or contract says something different from these terms, the quote or contract applies for that Booking.
2. Quotes and bookings
2.1 Quotes are valid for 14 days from the quote date unless the quote says otherwise. Equipment and crew aren't held for you until your Booking is confirmed.
2.2 Your Booking is confirmed when you accept the quote or contract (by signature, online acceptance or purchase order) and we receive any deposit the quote requires.
2.3 Quotes are based on the information you give us about the event or project, including dates, times, venue, access, power, audience size and technical requirements. If that information is incomplete, wrong or changes, we may change the Price and the equipment list.
2.4 Equipment may be substituted with items of equal or better specification if a quoted item is unavailable. We'll tell you about any substitution that changes what you'll experience.
2.5 We may decline any Booking at our discretion.
3. Prices, GST and fees
3.1 Prices are in Australian dollars and exclude GST unless shown otherwise. GST is added at the current rate.
3.2 Administration fee. An administration fee of 2% of the equipment hire charges applies to every quote and invoice that includes equipment hire, and is shown as a separate line.
3.3 Equipment is charged for the hire period shown on the quote, from when it leaves our warehouse until it is returned, including days it isn't used.
3.4 Crew are charged at the rates in the quote with a minimum call of 4 hours per person, per call. Overtime, penalty rates, travel time and allowances apply as set out in Part C.
3.5 We charge for variations you ask for or cause. These include extra equipment or crew, changed times, waiting time, venue access delays, after-hours or public holiday work, additional trips, parking, tolls, freight and accommodation. Where practical, we'll tell you the cost before doing the work.
3.6 We may adjust the Price before your Booking if our costs increase because of things outside our control, such as supplier price rises, exchange rates, freight or fuel. If the increase is more than 5%, you may cancel the affected part of the Booking without a cancellation charge within 3 days of our notice.
4. Deposits and payment
4.1 Unless your quote or invoice says otherwise, payment in full is due 7 days before bump-in.
4.2 We may require a 50% deposit to confirm a Booking, with the balance due 7 days before bump-in. Deposits secure equipment and crew for your dates and are dealt with as set out in clause 5.
4.3 Approved account customers must pay by the due date on each invoice. We may withdraw credit at any time.
4.4 Pay by direct deposit to the account shown on the invoice, using the invoice number as the reference. Other payment methods must be agreed with us first and may attract a surcharge equal to our cost of accepting them.
4.5 If you don't pay on time, we may suspend or cancel delivery or Services, hold any of your property in our possession, and stop work on any other Booking.
4.6 Interest on overdue amounts accrues daily at 2% per month from the due date until paid. You must also pay our reasonable costs of recovering overdue amounts, including debt collection, legal costs on an indemnity basis and bank fees.
4.7 You can't withhold or reduce payment because of a claim against us or because part of an invoice is disputed. Pay the undisputed amount and tell us about the dispute in writing within 7 days of the invoice.
5. Changes and cancellations
5.1 Tell us in writing (email is fine) if you need to change or cancel a Booking. A cancellation takes effect when we receive your notice.
5.2 If you cancel, the following charges apply, based on the quoted total for the cancelled Booking:
| Notice before bump-in | Cancellation charge |
|---|---|
| More than 7 days | Deposit kept |
| 3 to 7 days | 50% of the quoted total |
| Less than 3 days | 100% of the quoted total |
5.3 Whatever the notice period, you must also pay any costs we have already committed to for your Booking that we can't recover. These include sub-hired equipment, freight, travel, accommodation, third-party crew and special-order Goods.
5.4 Reducing a Booking within 7 days of bump-in is treated as a cancellation of the part removed.
5.5 Moving a Booking to new dates is treated as a cancellation of the original Booking unless we agree otherwise in writing. We'll try to accommodate date changes where equipment and crew are available.
5.6 We may cancel a Booking before bump-in by giving you written notice. If we do, other than because you have breached these terms, we'll refund what you've paid for that Booking, and we have no further liability to you.
6. Venue, access, power and permits
6.1 You are responsible for venue bookings and for all permits, approvals and permissions the event needs, including council permits, noise and curfew conditions, road closures and venue technical requirements, unless we agree in writing to arrange them.
6.2 You must give us safe, clear and level access for our vehicles, equipment and crew at the agreed times, including loading docks, lifts, ramps and parking close to the work area. Additional handling caused by stairs, long carries, soft ground or restricted access is charged as a variation.
6.3 You must provide suitable, safe and correctly rated power for the equipment quoted, located where we need it, unless we supply power or generators. We aren't responsible for faults or damage caused by inadequate or unstable power.
6.4 Before we start, you must tell us about any underground services, overhead hazards, rigging and floor load limits, asbestos or other site hazards. We aren't responsible for damage to services or structures you didn't tell us about.
6.5 You must comply with any venue, noise and curfew conditions. If we are directed to reduce volume, stop, or leave because of those conditions, the full Price still applies.
7. Safety and weather
7.1 We work to Queensland work health and safety laws. You must do the same, and make sure your staff, contractors, performers and guests don't interfere with our equipment, cabling or work areas.
7.2 Our crew may stop, change or refuse work, or refuse to rig, fly, raise or operate equipment, if they reasonably believe it is unsafe. This includes high wind, rain, lightning or extreme heat at outdoor events, and crowd or structural risks. Structures, LED screens, truss and staging have wind and load limits, and we will lower or shut them down when those limits are reached.
7.3 Where work is stopped or changed for safety reasons, the full Price still applies, and we aren't liable for the effect on your event.
7.4 Outdoor equipment needs protection from the weather. Unless we have quoted for weather protection, you must provide suitable cover for equipment, front-of-house and crew positions.
8. Delivery, set-up and collection
8.1 Times we give for delivery, set-up and pack-down are our best estimates. We aren't liable for loss caused by delays outside our control, such as traffic, weather or venue delays.
8.2 Someone authorised by you must be on site to receive the delivery, confirm the set-up and release equipment at collection. If we can't deliver, set up or collect at the agreed time because of you or the venue, we may charge waiting time and additional trips.
8.3 Equipment must be ready for collection at the agreed time and place. Equipment we can't collect continues to be charged at the daily hire rate.
9. Risk, insurance and indemnity
9.1 You must hold public liability insurance suitable for your event or premises, and insure our Equipment for its full replacement value while you are responsible for it. We may ask for a certificate of currency before bump-in.
9.2 You indemnify us against loss, damage, costs and claims arising from your use of the Equipment, your breach of these terms, or the acts of your staff, contractors, performers, guests or audience, except to the extent we caused them.
9.3 We aren't responsible for damage to the venue, site or your property unless it was caused by our negligence.
10. Your rights under the Australian Consumer Law
10.1 Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
10.2 Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.
11. Our liability
11.1 Subject to clause 10, we aren't liable for any indirect or consequential loss, including loss of profit, revenue, ticket sales, sponsorship, opportunity or reputation, or the cost of a cancelled, delayed or disrupted event.
11.2 Subject to clause 10, our total liability to you for any claim relating to a Booking is limited to the Price you paid for that Booking.
11.3 Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the goods or services again, repairing or replacing the goods, or paying the cost of doing so.
11.4 Technical equipment can fail despite testing and maintenance. If something fails, we will do what we reasonably can to repair or replace it promptly, and our liability is limited as set out in this clause and clause 10.
12. Events outside our control
12.1 Neither of us is liable for failing to perform because of events outside our reasonable control, such as severe weather, natural disaster, fire, flood, pandemic, government orders, power or network failure, industrial action, supplier failure or road closures.
12.2 If such an event stops a Booking going ahead, we'll work with you to reschedule. If that isn't possible, clause 5.3 still applies to costs we've already committed to, and we may keep any deposit as a credit for a future Booking within 12 months.
13. Security and the PPSA
13.1 These terms create a security interest in all Equipment we hire to you and all Goods we supply until they are paid for, for the purposes of the Personal Property Securities Act 2009 (Cth) (PPSA). We may register that interest on the PPS Register.
13.2 You must give us any information and sign any documents we reasonably need to register and protect our interest, and you must not register, or allow anyone else to register, a competing interest.
13.3 To the extent the law allows, you waive your right to receive notices under the PPSA, and sections 95, 118, 121(4), 125, 130, 132(3)(d) and 132(4) of the PPSA don't apply.
14. Designs, files, photos and marketing
14.1 Designs, drawings, plots, show files, programming, configurations and other material we create remain our intellectual property. Once you have paid in full, you may use them for the event or system they were created for.
14.2 You must have the rights to any content you give us to play, display or record, including music, video, images and logos, and you are responsible for any licences needed (for example from OneMusic Australia). You indemnify us against claims arising from content you provide.
14.3 We may photograph or film our set-ups and installations and use the images to promote our business, unless you tell us in writing before the event that you'd prefer we didn't. We won't publish images of your guests where they can be identified without permission.
15. Privacy and credit checks
15.1 We handle personal information as described in our Privacy Policy.
15.2 If you apply for a credit account, you agree that we may check your credit history with a credit reporting body and your trade referees, and may tell them if you don't pay, as allowed by the Privacy Act 1988 (Cth).
16. Disputes
16.1 If you have a complaint or dispute, contact us first in writing so we can try to resolve it. Both of us will act in good faith to resolve it within 14 days.
16.2 This doesn't stop either of us seeking urgent relief from a court, or us recovering overdue amounts.
17. General
17.1 These terms are governed by the laws of Queensland, and you agree to the courts of Queensland.
17.2 We may update these terms from time to time. The version on our website when you accept a quote applies to that Booking.
17.3 If any part of these terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we can still enforce it later.
17.4 We may use subcontractors or partner suppliers to deliver all or part of a Booking. You may not transfer your rights or obligations without our written consent.
17.5 You must tell us in writing at least 14 days before any change in your business's ownership, name, structure or contact details.
17.6 Notices may be given by email to the address on the quote, invoice or our website.
Part B: Equipment hire
This part applies to dry hire (where you collect, operate or look after our Equipment yourself) and to Equipment left in your care during a production. It applies alongside Part A.
18. Hire period, collection and return
18.1 The hire period runs from when the Equipment is collected or delivered to when it is returned to our warehouse or collected by us, as shown on the quote.
18.2 Collection and return are during our business hours by appointment. After-hours collection or return may be arranged for a fee.
18.3 Equipment returned late is charged at the daily hire rate for each extra day or part day, plus any cost to us of being unable to supply another booking.
18.4 You must transport Equipment in a suitable, covered and secure vehicle, upright where marked, and restrained so it can't move.
19. Identification and security
19.1 We may ask for photo identification, a company purchase order, or a security bond or credit card pre-authorisation before releasing Equipment.
19.2 We may apply a bond to any amount you owe under these terms, and refund the balance once the Equipment has been returned and checked.
20. Using the Equipment
20.1 Equipment stays our property at all times. You must keep it in your possession and control, and you must not sell, sub-hire, lend, modify or open it, or remove labels, tags or serial numbers.
20.2 The Equipment must be used only by competent people, for its intended purpose, following our instructions and the manufacturer's. Electrical work, rigging, flying and structures must be carried out by appropriately licensed or qualified people.
20.3 You must protect the Equipment from weather, moisture, drinks, sand, smoke and haze residue, heat, theft and misuse, and keep it secure when it isn't in use.
20.4 Only connect the Equipment to suitable, protected power supplies. Don't alter tested and tagged leads or plugs.
20.5 Speakers, amplifiers and other equipment must be operated within their safe limits. Damage from overdriving, clipping, incorrect connection or incorrect voltage is charged to you.
21. Checking the Equipment and faults
21.1 Check the Equipment when you receive it. Tell us about anything missing or faulty within 24 hours of receipt, or immediately if it affects your event, so we can fix or replace it.
21.2 If Equipment develops a fault, stop using it and contact us. Don't attempt repairs. We aren't responsible for faults caused by incorrect operation, settings or connection, and a call-out fee may apply if we attend for a fault that turns out to be operator error.
21.3 We don't give refunds for faulty Equipment you didn't tell us about during the hire period.
22. Damage, loss and cleaning
22.1 You are responsible for the Equipment from when it is collected by or delivered to you until it is returned to us or collected by us, whoever causes the loss or damage.
22.2 Return the Equipment clean, complete and packed as supplied, with cables coiled and cases latched. We may charge for cleaning, re-packing, re-coiling and consumables used, such as lamps, gaffer tape, batteries, haze and smoke fluid.
22.3 Damaged Equipment is charged at our cost of repair, including parts, labour and freight. If Equipment is lost, stolen or can't be economically repaired, you must pay its replacement cost with new equivalent equipment at current prices.
22.4 You must also pay the hire charges lost while Equipment is being repaired or replaced, up to the date the repair or replacement is complete.
22.5 You must report theft to the police and give us the report number within 24 hours.
Part C: Production, crew and event management
This part applies where we supply crew, operate equipment, design or manage the technical production of an event, or manage an event for you. It applies alongside Part A.
23. Our crew
23.1 Crew are charged at the rates in the quote with a minimum call of 4 hours per person, per call.
23.2 Unless the quote says otherwise, rates are based on a standard shift of up to 10 hours. Time beyond the quoted hours, work between midnight and 6 am, and work on weekends and public holidays are charged at our overtime and penalty rates.
23.3 Crew need a meal break of at least 30 minutes for every 5 hours worked. Where you can't provide a break, a meal penalty applies. Where the quote includes catering for crew, you must provide it at the agreed times.
23.4 Travel time, vehicle costs, tolls and parking are charged as quoted. For work more than 100 km from our warehouse, or where the schedule doesn't allow a safe rest break between shifts (10 hours), you must pay for suitable accommodation.
23.5 Our crew take directions from our crew chief. Requests for changes on the day should go through the crew chief and may be charged as variations.
24. Information we need from you
24.1 You must give us final run sheets, schedules, stage plots, input lists, artist riders, venue plans and contact details at least 7 days before bump-in, unless the quote says otherwise.
24.2 Video, LED and presentation content must be supplied in the formats and resolutions we specify at least 3 business days before bump-in. Content supplied late, or in the wrong format, may not be tested and may be charged for conversion.
24.3 Changes to artist, presenter or technical requirements after the details are finalised may require additional equipment or crew, charged as variations.
25. Rigging, staging and temporary structures
25.1 Rigging, truss, staging, LED screens and temporary structures are designed and installed to manufacturer and engineering specifications. Where engineering certification is needed, we will quote for it or you must provide it.
25.2 You must make sure any venue rigging points, roof structures and floors have current certification for the loads required. We may refuse to rig from points that aren't certified or that we reasonably believe are unsafe.
25.3 Structures may need ballast, wind monitoring and exclusion zones. You must keep the public and your contractors out of exclusion zones during installation, operation and removal.
26. Event management and third-party suppliers
26.1 Where we manage an event or engage third-party suppliers on your behalf, such as caterers, staging hire, fencing, toilets, security or entertainers, we do so as your agent unless the quote says otherwise. Those suppliers' terms apply to their services.
26.2 Third-party costs are passed on at the quoted price plus any management fee shown on the quote. Deposits and cancellation charges required by those suppliers are payable by you.
26.3 You remain responsible for decisions about the event's content, ticketing, guest safety, alcohol and security unless we have agreed in writing to manage them.
Part D: Equipment sales
This part applies when we sell Goods to you. It applies alongside Part A.
27. Orders and pricing
27.1 Orders are subject to availability. If an item is unavailable or discontinued, we will offer an alternative or a refund of any amount paid for it.
27.2 While we try to make sure prices are correct, errors can happen. If we find an error, we will tell you and give you the choice of confirming the order at the correct price or cancelling it.
27.3 Goods ordered in specially for you, including non-stock items, custom cables, cut-to-size materials and software licences, need a deposit of at least 50%. Special orders can't be cancelled once placed with our supplier, and the deposit is non-refundable.
28. Delivery and risk
28.1 Goods are delivered or collected as agreed. Delivery dates depend on our suppliers and are estimates only.
28.2 Risk in the Goods passes to you when they are delivered to you or collected by you or your carrier.
29. Ownership of Goods
29.1 Ownership of Goods passes to you only when we have received payment in full in cleared funds for those Goods and any other amount you owe us.
29.2 Until then, you hold the Goods for us, must keep them separate and identifiable, and must return them if we ask. You authorise us to enter premises where the Goods are kept to recover them if you don't pay.
30. Warranty and returns
30.1 New Goods come with the manufacturer's warranty in addition to your rights under the Australian Consumer Law. We will help you make a warranty claim with the manufacturer or its Australian distributor.
30.2 Warranty doesn't cover damage from misuse, accident, incorrect installation, power surges, water, unauthorised repair or modification, or normal wear and tear.
30.3 Tell us about any shortage, damage or incorrect item within 7 days of delivery.
30.4 We may accept non-faulty Goods for return within 14 days of delivery, at our discretion, if they are unused and in their original condition and packaging. A restocking fee of up to 25% of the price, plus freight, applies. We don't accept change-of-mind returns of special orders, consumables, cut cables or opened software.
30.5 Second-hand or ex-hire Goods are sold in their current condition, and you have the opportunity to inspect them before purchase. This doesn't affect your rights under the Australian Consumer Law.
Part E: Installations and system integration
This part applies when we design, supply, install, program or commission audio, lighting, video, control or staging systems at your premises. It applies alongside Part A.
31. Scope and exclusions
31.1 Our quote and any scope document set out what is included. Anything not listed is excluded.
31.2 Unless the quote says otherwise, the following are excluded: building, carpentry, painting and patching; electrical work requiring a licensed electrician; data cabling outside our scope; concealment of cables in walls or ceilings; structural engineering; permits and approvals; network and IT configuration on your systems; and work outside normal business hours.
31.3 Our quote relies on a site inspection or the drawings you provide. If site conditions differ, such as hidden services, asbestos, inaccessible ceilings or unsuitable structures, the extra work is a variation.
32. Design and documentation
32.1 System designs, drawings, schematics and programming are our intellectual property until you have paid in full. After that, you may use them to operate and maintain the system they were created for.
32.2 Design work done before a Booking is confirmed may be charged if the project doesn't go ahead with us.
33. Your site
33.1 You must give us safe access to the site at the agreed times, with the work areas clear, power and lighting available, and secure storage for equipment and materials.
33.2 You must coordinate other trades so we can work without delay. Delays, return visits and standing time caused by others or by the site not being ready are charged as variations.
33.3 We aren't responsible for existing equipment, cabling or infrastructure you ask us to reuse or connect to.
34. Installation payments
34.1 Unless the quote sets out a different schedule, we invoice 50% on acceptance, progress claims as work proceeds, and the balance on practical completion. We order equipment once the deposit is received.
34.2 Invoices for installations are payable within 7 days unless the quote or invoice says otherwise.
34.3 Where the Building Industry Fairness (Security of Payment) Act 2017 (Qld) applies, our invoices may be payment claims under that Act, and nothing in these terms limits our rights under it.
35. Variations
35.1 Changes to the scope must be agreed in writing (email is fine) before we do the work. We will price variations at our current rates and may adjust the completion date.
35.2 Where urgent work is needed for safety or to protect the installation, we may carry it out and charge it as a variation, and we'll tell you as soon as practical.
36. Practical completion and handover
36.1 Practical completion is reached when the system is installed, commissioned and working as specified, apart from minor items that don't stop you using it.
36.2 At handover we provide a walkthrough, basic operator training as quoted, and as-built documentation, user guides and passwords once the final invoice is paid.
36.3 Using the system for its intended purpose, other than for testing, is acceptance of practical completion.
37. Workmanship warranty and defects
37.1 We warrant our installation workmanship for 12 months from practical completion. Equipment is covered by its manufacturer's warranty. We will fix workmanship defects you report in writing during that period at no charge.
37.2 The warranty doesn't cover faults caused by misuse, accidental damage, power surges or lightning, water, pests, changes or repairs by others, firmware or software updates we didn't carry out, changes to your network, or consumables such as lamps and batteries.
37.3 Call-outs for issues not covered by the warranty are charged at our standard service rates.
38. Programming, control systems and support
38.1 Keep a backup of programming and settings we hand over. We keep a copy for at least 12 months after practical completion.
38.2 Remote and on-site support outside the warranty, preventative maintenance and system updates are available under a separate support agreement or at our standard rates.
38.3 If you or others change programming or settings, the warranty doesn't cover problems that result, and restoring them is charged at our standard rates.
Part F: Repairs and servicing
This part applies when you bring equipment to us, or we attend your site, for testing, repair, servicing or test-and-tag. It applies alongside Part A.
39. Assessment and quotes
39.1 An assessment fee may apply to diagnose a fault. If you approve the repair, the assessment fee is included in the repair price.
39.2 We won't carry out repairs over the assessed amount without your approval. Repair times depend on parts availability from manufacturers.
40. Your data
40.1 Back up show files, presets, settings and other data before giving us equipment. Repairs and firmware updates can erase data, and we aren't responsible for data loss.
41. Repair warranty
41.1 We warrant our repair work for 3 months from the date the equipment is returned to you. This covers the same fault in the parts we repaired or replaced, not other faults.
42. Uncollected items
42.1 Please collect repaired equipment within 30 days of our notice that it is ready. We may charge storage after that.
42.2 We have a lien over equipment left with us until all amounts owing are paid. Equipment that isn't collected and paid for within 90 days of our notice may be sold or disposed of in accordance with the Disposal of Uncollected Goods Act 1967 (Qld), and we may keep the proceeds to cover what you owe.
